Terms and Conditions
Welcome to TaxCure360 (the "Platform," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the website located at taxcure360.com and any associated subdomains, services, mobile applications, and software tools provided by TaxCure360.
By creating an account, purchasing a subscription, or using the Platform, you ("User," "Client," or "you") agree to be bound by these Terms. If you do not agree, do not use the Platform.
Description of Services
TaxCure360 provides a white-labeled customer relationship management (CRM) and marketing automation platform built on third-party software. Services include, but are not limited to, lead management, email marketing, SMS text messaging, sales funnels, call tracking, and automated workflows.
TaxCure360 is a software provider only. We do not provide legal, financial, or certified tax preparation services through this software.
Account Registration & Security
- Eligibility: You must be at least 18 years old and capable of forming a binding contract to use this Platform.
- Account Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
- Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account or any sub-accounts you create. You must notify us immediately of any unauthorized use.
Subscriptions, Fees, and Rebilling
A. Subscription Fees
Access to certain features of the Platform requires a paid subscription. You agree to pay all applicable fees specified at the time of purchase. All fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable unless otherwise stated.
B. Usage-Based Fees (Rebilling)
Because the Platform utilizes third-party telephony and email carriers, certain actions incur usage-based fees. These include, but are not limited to:
- Outbound and inbound SMS/MMS messages.
- Outbound and inbound phone calls and call tracking.
- Email verifications and email sending volumes.
You agree that these costs will be automatically charged to your payment method on file based on your consumption, or deducted from a pre-funded wallet balance within your account.
C. Non-Payment and Suspension
Failure to pay subscription fees or usage-based balances will result in the immediate suspension of your access to the Platform. We are not liable for any data loss or business disruption caused by account suspension due to non-payment.
Acceptable Use and Compliance Policy
You are entirely responsible for the content and communications transmitted through your account. You strictly agree not to use the Platform to:
- Violate Communication Laws: You must comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the General Data Protection Regulation (GDPR), and all other local, state, or federal laws regarding text messaging and emailing.
- A2P 10DLC Registration: If sending SMS in the United States, you agree to comply with all A2P 10DLC registration requirements. Failure to register or providing fraudulent business information may result in immediate account termination.
- Transmit Prohibited Content: You may not send messages related to illegal substances, hate speech, harassment, pyramid schemes, or deceptive financial/tax scams.
- Spam: Sending unsolicited text messages or emails without explicit, documented opt-in consent from the recipient is strictly prohibited.
Third-Party Software and Services Disclaimer
TaxCure360 is a white-labeled interface built on top of third-party software infrastructure (including GoHighLevel, Twilio, Mailgun, and other service providers).
We do not guarantee 100% uptime, as system availability is largely dependent on these third-party infrastructures.
We are not responsible for any service interruptions, data delivery failures, or dropped calls caused by third-party carrier networks.
Intellectual Property
- Our Property: TaxCure360 retains all rights, title, and interest in and to our brand, logos, custom templates, training materials, and website content.
- Your Data: You retain all ownership rights to the data, contacts, and customer lists you upload to the Platform. You grant us a limited license to host, transmit, and back up your data solely to provide the services to you.
No Professional Financial or Tax Advice
The templates, snapshot configurations, pipelines, and automated text/email copy provided within TaxCure360 are for marketing and operational organizational purposes only. They do not constitute professional tax, accounting, or legal advice.
You are solely responsible for ensuring that any automated messages sent to your clients comply with tax industry regulations.
Limitation of Liability
To the maximum extent permitted by law, TaxCure360, its directors, employees, or partners, shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, loss of data, loss of business reputation, or tax penalties incurred by you or your clients, arising out of your use or inability to use the Platform.
Our total liability for any claim arising out of these Terms shall not exceed the total amount paid by you to TaxCure360 in the three (3) months preceding the event giving rise to liability.
Termination
We reserve the right to terminate or suspend your account at our sole discretion, without prior notice, for conduct that we believe violates these Terms, harms other users, or infringes upon the law. Upon termination, your right to use the Platform ceases immediately, and your data may be permanently deleted after 30 days.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action arising under these Terms must be filed in the courts located in Texas.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
